Terms of Use.

These Terms of Use ("Terms") govern your access to and use of the Checkfit mobile application and checkfit.com (collectively, the "Service"), operated by Checkfit / Moodzer ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into this agreement.

2. Your account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate, current information and to keep it updated.
• Notify us immediately of any unauthorized use of your account.

3. Subscriptions and billing

• The Service is offered on a subscription basis. Pricing is displayed in the app at the point of purchase.
• Subscriptions are processed through Apple In-App Purchase. Apple's terms apply to the transaction.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings.
• Refunds are handled by Apple in accordance with their policies. We are not able to issue refunds directly.
• Early-access pricing, where offered, is honored for the life of an active subscription, subject to these Terms.

4. Health and safety disclaimer

Checkfit provides strength training programs for general fitness purposes. It is not medical advice. We are not licensed physicians, physical therapists, or registered dietitians.

• Consult a qualified healthcare professional before starting any new exercise program, especially if you have a medical condition, injury, or are pregnant.
• Stop exercising and seek medical attention if you experience pain, dizziness, or any symptoms that concern you.
• You assume all risks associated with the physical activity you choose to perform.

The Service is provided for informational and educational purposes. Your reliance on any program or recommendation is at your own risk.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Use the Service to develop a competing product.
• Scrape, mine, or otherwise extract data from the Service in bulk.
• Interfere with or disrupt the Service or the servers and networks connected to it.
• Share your account credentials or transfer your account to another person.

6. Intellectual property

The Service, including all content, code, design, exercise illustrations, copy, and trademarks (including "Checkfit"), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms.

7. Your content

You retain ownership of the data you log in the Service (lifts, sets, notes, measurements). You grant us a limited license to host, process, and display that data solely to provide the Service to you. We do not claim ownership over your training data and we do not sell it.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you violate these Terms or if your use of the Service poses a risk to us or to other users. On termination, your right to use the Service ends; sections of these Terms that by their nature should survive will survive (including intellectual property, disclaimers, limitations of liability, and dispute resolution).

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will produce specific fitness, weight, or body composition results.

10. Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred US dollars ($100).

11. Indemnification

You agree to indemnify and hold harmless Checkfit / Moodzer, its affiliates, officers, and employees, from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party right.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration administered by JAMS, in Los Angeles County, California, except that either party may bring a claim in small claims court. You waive any right to a jury trial and to participate in a class action.

13. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice. Continued use of the Service after a change constitutes acceptance of the updated Terms.
